1. Agreement to Terms

By accessing or using ViaMetric, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.

2. Description of Service

ViaMetric provides web analytics services ("Service"). We offer different subscription plans including a Starter tier and a Pro tier with enhanced features.

3. Accounts

When you create an account with us, you must provide information that is accurate, complete, and current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service.
You agree not to disclose your password to any third party.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (e.g., monthly).

Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing cycle.
Refunds: Unused periods are generally non-refundable, except as required by law.

5. Third-Party API Usage (Bring Your Own Key)

ViaMetric allows you to integrate your own API keys from third-party providers (e.g., OpenAI, Perplexity) to enable AI-driven features. By using this feature, you acknowledge and agree that:

You are solely responsible for obtaining and maintaining valid API keys from the respective providers.
You are solely responsible for all charges and fees incurred by your usage of these third-party APIs. ViaMetric does not cover these costs.
ViaMetric is not affiliated with OpenAI, Perplexity, or other API providers and makes no warranties regarding their service availability or performance.

6. Acceptable Use

You agree not to use the Service to tracking illegal activities or to collect sensitive personal data without consent. You must comply with all applicable laws, including GDPR and CCPA, when using our analytics tools on your websites.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ViaMetric and its licensors.

8. Limitation of Liability

In no event shall ViaMetric, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes.
